The buying or selling of a home is usually the first time a person has to interact with an attorney to represent them . We know this can sometimes be a scary and frightening experience for an individual. As a result, we work with the client to first ease their fears of the process and ensure them we will control the transaction and do everything in our power to protect their rights and interests during this process.
We work with the client both with and without a realtor involved. We advise and counsel clients during the entire process from the time the client lists the property through the consummation of the sale at closing. We review and draft (when necessary) the real estate contract in the most favorable terms for the client. In a sale situation, we order the title commitment and survey and draft all the closing documents for the client along with obtaining their mortgage payoff, if any.
When a client is buying real estate, we advise the client on the best way they should take title to their new real estate. In a sale situation, we usually have the client sign a power of attorney so the client does not have to attend the closing. We attend the closing and bring back to the client their net proceeds check and closing statement.
If a purchase involves a client obtaining a mortgage, the use of a power of attorney may not be allowed by the mortgagee and thus the client has to attend the closing to sign all the mortgage documents.
We fully explain all the mortgage documents at the closing to the client. In addition, we draft and review both personal and business leases for clients.
